These terms govern the certified translation services ordered by any consumer from Legal230 SAS (Transdoc), in accordance with the French Consumer Code and French digital economy law (LCEN).

These terms and conditions of sale (hereinafter the "Terms") set out the rights and obligations of the parties in connection with the online order, by a consumer within the meaning of the preliminary article of the French Consumer Code, of certified, sworn or official translation services provided by Legal230 SAS trading as Transdoc.

In these Terms, the following terms shall have the following meanings:
Validating an Order implies full and unreserved acceptance of these Terms by the Client. Before any payment, the Client is asked to tick a specific box confirming that they have read, understood and accepted these Terms and the Privacy Policy. This electronic acceptance has, between the parties, the same value as a handwritten signature pursuant to Article 1367 of the French Civil Code.
The Terms applicable are those in force on the date the Order is validated. The Provider reserves the right to amend them at any time; Orders in progress remain governed by the version accepted at the time they were validated.
The Order follows the steps below:
In accordance with Article L.213-1 of the French Consumer Code, where the Order amount is equal to or greater than €120, the Provider archives the electronic contract for a period of ten (10) years and guarantees the Client access to it at any time upon request.
Service prices are shown in euros (EUR), all taxes included, including applicable French VAT. The price applicable is the one displayed on the Site at the time the Order is validated. No hidden fees apply: delivery of the PDF and postal delivery by tracked mail within France are included, unless an explicit premium option is chosen.
Quotes issued outside the standard order tunnel are valid for thirty (30) days from their date of issue, unless expressly stated otherwise. The Provider reserves the right to change its prices at any time; new rates apply only to Orders placed after they are published.

Online payments are processed by an authorised payment service provider compliant with the PCI-DSS standard and implementing strong Client authentication (3-D Secure 2) as required by the European PSD2 directive. The Provider never has access to the Client's full card details.
The Service is payable in full at the time of order. No work begins until payment has been collected. An electronic invoice in PDF format, compliant with Article 289 of the French General Tax Code, is sent to the Client at the email address provided when placing the Order.
The turnaround times offered by Transdoc are expressed in business days (Monday to Friday, excluding French public holidays):
The turnaround time begins once both (i) payment in full and (ii) a legible and complete Source document have been received. The turnaround time may be suspended, after informing the Client, in the following cases: an illegible or partial document, a mismatch between the service ordered and the document provided, a request for clarification from the Translator, or documents containing more pages than the plan chosen.
In the event of an unjustified delay by the Provider, the Client may, in accordance with Article L.216-6 of the French Consumer Code, terminate the contract after a written notice has remained unanswered for a reasonable period, and obtain reimbursement of the sums paid within fourteen (14) days.
The Translation is delivered as follows:
Postal delivery times (24 to 72 hours within mainland France, longer internationally) are not included in the turnaround times set out in Article 8 and are the carrier's responsibility. The risk of loss or damage transfers to the Client upon actual delivery of the item.
In accordance with Article L.221-18 of the French Consumer Code, the Client generally has a period of fourteen (14) days from the conclusion of the contract to exercise their right of withdrawal, without having to justify their decision.
During the Order process, the Client expressly acknowledges, by ticking a box provided for this purpose, that:
Failing this, the Client may exercise their right of withdrawal by sending an unambiguous letter or email to contact@transdoc.legal230.fr, before any performance begins.
The Provider undertakes to perform the Services with all the care, diligence and professionalism expected of a certified translation specialist. The Provider is subject to an enhanced best-efforts obligation.
The Provider's liability cannot be engaged in the event of force majeure within the meaning of Article 1218 of the French Civil Code (an event beyond the Provider's control, reasonably unforeseeable, whose effects cannot be avoided by appropriate measures). Force majeure notably includes: natural disasters, general strikes, major telecommunications network outages, declared epidemics, and acts of public authority. The Provider informs the Client as soon as possible and, where applicable, offers a reasonable postponement or a refund.
The Translation delivered is warranted to conform to the Order and its Source document. Any defect of conformity must be reported in writing within thirty (30) days of delivery. The Provider will carry out the correction free of charge as soon as possible.
If a Translation produced by Transdoc is rejected by a French administration for a reason strictly relating to its form (certification statement, signature, stamp, binding, compliance with the legal framework for certified translation), the Provider undertakes to redo the Translation free of charge, subject to the Client providing written proof of refusal issued by the administration concerned.
The Client benefits in any event from the statutory warranties of conformity and against hidden defects provided for in Articles L.217-3 et seq. of the French Consumer Code and Articles 1641 et seq. of the French Civil Code.
The Provider's liability towards the Client is limited to the tax-inclusive amount actually paid for the Service concerned, except in the case of gross or wilful misconduct. The Provider cannot be held liable for:
The economic copyright attached to the Translation (reproduction, performance, adaptation) is assigned to the Client on an exclusive basis, worldwide, for the statutory term of copyright, from the date the price is paid in full. Before this payment, no right of exploitation is transferred.
The Translator's moral rights remain inalienable, in accordance with the mandatory provisions of Article L.121-1 of the French Intellectual Property Code. The tools, processes, translation memories, glossaries, interfaces and software used by the Provider remain its exclusive property.
The Provider and the Translator are bound by a strict duty of confidentiality regarding all documents and information provided by the Client. Each translator working with Transdoc signs an individual confidentiality undertaking. Source documents are stored on servers hosted in France, in an encrypted environment, and are accessible only to persons strictly authorised to process them.
Personal data collected as part of the Order is processed by Legal230 SAS, acting as data controller, in accordance with Regulation (EU) 2016/679 (GDPR) and French Act No. 78-17 of 6 January 1978, as amended. The details of the processing, its purposes, legal bases, retention periods and the Client's rights are set out in the Privacy Policy & GDPR, which forms an integral part of these Terms.
Any complaint should be addressed, amicably and in the first instance, to customer service at contact@transdoc.legal230.fr or by post to the registered office. The Provider undertakes to acknowledge receipt within 48 business hours and to provide a reasoned response within a maximum of thirty (30) days from receipt of the complaint.
In accordance with Articles L.611-1 et seq. of the French Consumer Code, the consumer Client has the right to use a consumer mediator free of charge to seek an amicable resolution of any dispute with the Provider, after first attempting to resolve it directly with customer service.

These Terms are governed by French law. The language of the contract is French. Where these Terms are translated for information purposes, only the French version is binding between the parties.
Failing an amicable resolution, any dispute relating to the formation, performance or interpretation of these Terms shall be submitted to the competent French courts.
In accordance with Article R.631-3 of the French Consumer Code, the consumer Client may bring proceedings, at their choice, before one of the following courts: the court of the place where they resided when the contract was concluded, the court of the place where the harmful event occurred, or the court of the place of the Provider's registered office (Paris courts).
