Case 1: marriage celebrated in France with a foreign spouse

When a French national wishes to marry a foreign national in France, the town hall (mairie) where the ceremony will take place (the commune of residence, or of continuous residence of the parents for more than one month) opens a marriage file. If one of the future spouses is foreign, the town hall simultaneously builds a CCAM (Certificate of Capacity to Marry) file.

Documents required by the town hall

  • Birth certificate of both future spouses, less than 3 months old (6 months for certificates issued abroad). See birth certificate translation.
  • A valid proof of identity.
  • Recent proof of address for both future spouses.
  • Certificate of celibacy or of non-remarriage for the foreign spouse-to-be (for countries that issue one).
  • Certificate of custom · a document issued by the consulate or a legal authority of the country of origin, setting out the applicable family-law rules.
  • Divorce judgment (showing no pending appeal) if the future spouse is divorced. See divorce judgment translation.
  • Death certificate of the previous spouse in case of widowhood.
  • List of witnesses and their proof of identity.

The possible preliminary interview

Where there is doubt about the genuine intention to marry, the registrar may conduct a joint or separate interview of the future spouses (Article 63 of the French Civil Code). This interview may be delegated to the French consulate in the foreign spouse's country of origin. Foreign documents must be translated before this interview.

Case 2: transcribing a marriage celebrated abroad

When a French national marries abroad, the foreign marriage certificate must be transcribed onto the French civil status registers for it to produce legal effects in France (transmission of nationality to children, matrimonial regime, inheritance rights, etc.).

The competent authority

  • French consulate in the country where the marriage was celebrated · the primary authority.
  • SCEC Nantes (Central Civil Status Service) · centralises the civil status records of French nationals living abroad and directly receives transcription requests for certain sensitive countries.

Documents to provide

  • Foreign marriage certificate as a full copy, apostilled or legalised, translated by a French sworn translator. See marriage certificate translation.
  • Birth certificates of both spouses.
  • Divorce judgment if applicable.
  • Duly completed CERFA transcription request form.
  • Copies of proof of identity.
Validity check: transcription is not automatic. The consulate or the SCEC verifies that the marriage complies with French public policy (consent, capacity, no bigamy). Polygamous marriages, marriages involving minors, or marriages without genuine consent are not transcribed.

Opposition to marriage and marriage fraud

The French Civil Code strictly regulates mixed marriages to prevent fraudulent unions:

  • Article 63 of the Civil Code · preliminary interview of the future spouses by the registrar.
  • Articles 171-1 to 171-8 of the Civil Code · specific regime for marriages contracted abroad by a French national, with a requirement to publish the banns and for the French consulate to issue a CCAM.
  • Article 175-1 of the Civil Code · the public prosecutor may oppose the marriage where there is serious evidence of a sham marriage, suspending the ceremony for up to 2 months (renewable once).
  • Article 184 of the Civil Code · absolute nullity of a marriage contracted without free consent.

During an interview at the town hall or the consulate, having clear, compliant translations on file is a favourable factor that avoids conflicting interpretations.

Mixed PACS: specific requirements

The French civil partnership (PACS) is open to mixed couples, whether of the same sex or different sexes. The procedure requires:

  • Birth certificate of both partners (less than 3 months old for French certificates, less than 6 months for foreign certificates).
  • Certificate of no existing PACS and no existing marriage for the foreign partner.
  • Certificate of custom (for certain countries).
  • PACS agreement.

The PACS is registered at the town hall of the couple's shared place of residence, or before a notary. Unlike marriage, it does not confer nationality but does open property, tax, and social rights.

Ask the foreign registrar for it when you collect the certificate.

What is a CCAM?

The Certificate of Capacity to Marry (CCAM) is issued by French consular authorities to a French national wishing to marry abroad. For a marriage celebrated in France with a foreign spouse, the town hall builds an equivalent file from the civil status documents translated by a sworn translator.

What is a certificate of custom?

A document issued by the consulate or a legal authority of the country of nationality, setting out the family-law rules that apply to the future spouse: capacity to marry, impediments, default matrimonial regimes. It must be translated by a sworn translator if drafted in a foreign language.

Can a mixed marriage be legally opposed?

Yes. Articles 171-2 and 175-1 of the French Civil Code allow the public prosecutor to oppose a mixed marriage where fraud is suspected (sham marriage, lack of consent, seeking an immigration advantage). A separate interview of the future spouses may then be arranged.

Does a mixed PACS require the same documents?

Yes. A mixed PACS also requires a translated birth certificate less than 6 months old, and a certificate of non-marriage / non-PACS for the foreign partner. The documents are filed with the judicial court, the town hall, or a notary.

Can I get married at the French consulate?

Only in a small number of countries where France retains consular jurisdiction over marriage matters. In the vast majority of cases, the marriage will be celebrated before the local authorities of the country, then transcribed at the consulate or the SCEC in Nantes.
